David Mallen focuses his practice in the areas of advertising and consumer protection law. He represents marketers from a variety of industries in connection with national advertising campaigns, analysis of claim substantiation issues, green marketing, digital media issues and resolution of advertising disputes. David is an experienced trial lawyer with expertise representing clients in all phases of litigation in state and federal court and in alternative dispute resolution. As former Deputy Director of the National Advertising Division (NAD) of the Council of Better Business Bureaus, David has extensive experience representing advertisers before NAD, the Federal Trade Commission and other regulatory and self-regulatory agencies.
David provides practical guidance to marketers of food and beverages, cosmetics, OTC drugs, telecommunication services, retail, consumer household products, dietary supplements, and technology service providers. He is also a popular speaker and lecturer at conferences and workshops on advertising claim substantiation, industry self-regulation, social media advertising, sustainability and green marketing, and scientific sensory testing.
David is the co-author of How To Make Credible Green Marketing Claims. What Marketers Need to Know about The Updated FTC Green Guides. (Ad Age, September 2013). He was Editor-in-Chief of the American Bar Association’s Advertising Claim Substantiation (ABA, 2017) and co-author of Practical Guide to Comparative Advertising: Dare to Compare (Elsevier Science, 2018).
